Terms of Service for Parahub Instance

IMPORTANT: PLEASE READ CAREFULLY!
By using this Parahub instance managed by Parahub - Associação you fully and unconditionally accept these Terms of Service as well as the Parahub Manifesto, Parahub Code of Conduct and Articles of Association (Estatutos). If you do not agree with these terms you must not use the Service.
1. About Parahub Service
Parahub is a decentralized, federated open-source software platform operated by Parahub - Associação (NIPC 519046161), a Portuguese private non-profit association of international scope. The platform is designed for direct cooperation, exchange, communications, and mutual aid between users. This Service is one of the independent instances (nodes) of the Parahub network. The Operator provides access to the functionality of this instance. The platform never holds, stores, or manages user funds and does not act as a financial intermediary. The Association is governed by its Articles of Association (Estatutos), available at the /estatutos page.
2. Acceptance of Manifesto, Code of Conduct and Estatutos
- By using the Service, the User confirms that they have read, understood, and fully accept the principles outlined in the Parahub Manifesto.
- The User agrees to comply with the Parahub Code of Conduct in all their interactions through the Service.
- The User acknowledges the existence of the Association's Articles of Association (Estatutos), which define the legal framework, governance and aims of the Parahub Association.
3. User Responsibilities
Your Keys, Your Responsibility
The User bears full and exclusive responsibility for creating, securely storing, and using their cryptographic keys (e.g., PGP). The Operator never requests or has access to the User's private keys. Loss of a private key may result in irreversible loss of access to certain features or data signed with that key.
Trust in Electronic Signatures (Digital Signatures/PGP)
The User acknowledges and agrees that actions confirmed by their cryptographic signature (e.g., PGP) within the Service represent their intent and may have legal or reputational consequences according to Parahub system rules and agreements between users.
Content and Interactions
The User bears full responsibility for all content they publish, transmit, or receive through the Service, as well as for all their interactions with other users.
Legal Compliance
The User agrees to use the Service in strict accordance with applicable laws of their jurisdiction and the jurisdiction of the Operator's location.
Account Security
The User is responsible for maintaining the confidentiality of their credentials for accessing the Service.
4. Disclaimer of Warranties and Operator Liability
'AS IS' Service
The Service is provided 'as is' and 'as available'. The Operator provides no express or implied warranties regarding the Service, including but not limited to warranties of fitness for particular purposes, uninterrupted operation, absence of errors, viruses, or other harmful components.
NO OPERATOR LIABILITY
- The Operator is not liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, data loss, reputational damage, arising from the use or inability to use the Service.
- The Operator is not a party to transactions, agreements, or disputes between Service Users. All responsibility for concluding, executing, and resolving transaction disputes lies exclusively with the Users.
- The Operator does not control and is not responsible for content created by Users, its legality, accuracy, or reliability.
- The Operator is not responsible for actions or inactions of other Service Users.
- The Operator is not responsible for the functioning of external services integrated with Parahub (e.g., Matrix, Lightning Network, Gitea) if they are managed by third parties.
Maximum Liability
If, despite the above, it is determined that the Operator bears any liability, the aggregate amount of such liability cannot exceed the symbolic amount of 1 (one) euro or the minimum amount permitted by law.
5. Operator Rights
The Operator reserves the right to:
- Modify or discontinue the Service (or any part thereof) temporarily or permanently, with or without notice.
- Establish general practices and limits on Service usage.
- Remove or refuse to publish any content at its discretion, especially in case of violation of this Agreement, Manifesto, or Code of Conduct.
- Suspend or terminate User access to the Service for violation of this Agreement, Manifesto, Code of Conduct, or for other valid reasons.
6. Agreement Modifications
The Operator may modify this Agreement at any time. The new version of the Agreement takes effect from the moment of its publication on the Service, unless otherwise specified. Continued use of the Service after changes means the User's full agreement with the new version of the Agreement.
7. Applicable Law and Dispute Resolution
This Agreement is governed by and construed in accordance with the laws of Portugal. All disputes arising from or in connection with this Agreement shall be resolved through negotiations. If agreement cannot be reached, disputes shall be submitted to the competent court at the Operator's location.
